DELIVERY TERMS
Entry into force
The delivery terms of Népra Oy (“Company”) are in force as of the date mentioned above, and shall replace any delivery terms published by Company before said date.
These terms shall apply to agreements between you and Company (Népra Oy, business ID 2724209-3; address PO Box 33 13211 Hämeenlinna, Finland; email customercare@wearnepra.com). The terms cover, e.g., information on shipping from our online store, prices, returning products and payment.
General
We do not guarantee that all items included in the e-shop are in stock at the time of your order. We reserve the right not to deliver in case of any misconception with our stock level at the time of receiving your order. In the event that an item is unavailable, we will contact you shortly by e-mail.
We reserve the right to cancel a sale or to adjust the price of a sale in the event the purchased product or its price are not in line with real market prices due, for example, to a technical error in the online store or a human error.
We reserve the right to make changes to prices and terms. You as the customer undertake to comply with these terms when making a purchase.
There is no right to exchange or return Company products, to cancel the purchase, or to withdraw from the purchase unless otherwise expressly indicated below.

Payment can be made by Paytrail Visa, Master Card, American Express, MobilePay, through Finnish Internet Banks, PayPal or Klarna.

Paytrail Plc acts as a collecting payment service provider and is an authorized Payment Institution. Paytrail Plc will be shown as the recipient on your bank or credit card statement. Paytrail Plc will forward the payment to the merchant. For reclamations, please contact the website the payment was made to.

Other payment terms
All our prices include VAT (value added tax) as applicable, and prices are indicated in EUR (€) unless otherwise indicated.
All products remain the property of Népra Oy until full payment is made. The Company or its payment collector is entitled to charge interest for late payment in accordance with Section 4 of the Finnish Interest Act.
Right of withdrawal
If you are purchasing Company products as a consumer, you have a limited right of withdrawal as specified below. You may withdraw from your contract purchasing a Company product by notifying us within 14 days of receiving the product that you are exercising your right of withdrawal. You can do so by notifying our customer service: customercare@wearnepra.com. You can return the product you have ordered (for deliveries to the EU) by using the bill of lading provided by us to you. Return fee is 5€. However, for deliveries outside EU, you must pay the shipping fees and return fee for returning the product. We note that we will not accept returned products in the event they are shipped using payment on delivery. Products must be returned as specified above, i.e. for products shipped to the EU using a bill of lading, and for products shipped outside the EU, a mode of shipping selected and paid for by you. Please note that failure to collect a delivery is not the same thing as a withdrawal, and shall not be deemed as such.
Products returned in connection with withdrawal must be unused and undamaged. Products must be securely packaged, primarily using the same package in which they were shipped, and the product should in general be protected as instructed by the shipping company or postal service.
Company will refund the purchase price of the product within 14 days of receiving a notification of withdrawal after Company has received the ordered product in unused and undamaged condition.
The withdrawal right is only available with regards to unused and undamaged products.
Notice of defect and liability
In the event a product is damaged or has a defect at the time of delivery, you have a right and (in the event you wish to request a replacement product or compensation) a duty to provide notice of the damage/defect to Company. The notice must be sent by email to customercare@wearnepra.com without delay and in any event within two months of your having noticed the damage or defect. As the buyer, you have an obligation to carefully inspect the received product upon delivery to ensure that it is free of defect. In the event you neglect the obligation to inspect the goods and to provide notice of defect within the period referred to above, Company shall not be liable for any defect or damage to the product. For the avoidance of doubt, Company shall furthermore not be liable for any defect or damage that is incurred after delivery or otherwise as a result of your actions.
If a product has a defect or damage upon delivery, Company shall always primarily have a right to replace the damaged or defective product, and after the ending of the 14 day withdrawal period referred to above the contract can be cancelled or reduction in price requested only if Company fails to offer a replacement product within a reasonable period. Company may, at its discretion, compensate a defect/damage either by sending a new product or compensating the purchase price in part or in full.
Upon sending a notice of defect/damage, contact our customer support using the email address mentioned above, and we will, if necessary, send you a product return form and a bill of lading for returning the goods free of charge (in the EU). Products must be returned using the form and bill of lading referred to above (for the EU), and Company will not accept returned products sent, e.g., using payment upon delivery. Products must be securely packaged, primarily using the same package in which they were shipped, and the product should in general be protected as instructed by the shipping company or postal service.
Company tests returned products to ensure that the information in the description of defect in the product return form is correct, so please ensure to provide a detailed description of the defect/damage.
No Additional Warranty
While the Company is responsible for defects in the products at the time of shipping as provided above, the Company gives no additional warranty for its products, including with regards to their fitness for any particular or general purpose, or suitability for the customer’s use or personal taste. In particular, the way colours are rendered on a computer screen is dependent on screen and browser settings, and therefore we cannot guarantee that the colours shown on the website are exactly the colours of the actual active wear, and in the event you are disappointed with the colours of the shipped product this will not be deemed a defect in the product.
Data protection
Company complies in its operations with the EU General Data Protection Regulation (”GDPR”), Finnish national data protection legislation and the instructions and orders of the supervisory authority. The data protection policies of the Company are more fully laid out in the Company’s privacy policy.
Force majeure
In the event the Company is unable to ship an order or otherwise fulfil its obligations due to disruptions in manufacturing or logistics caused by fire, industrial action or strike, a pandemic, or other unforeseen obstacles outside the control of the Company, the failure to perform its obligations shall not be deemed as a breach of contract while the aforementioned obstacle prevents fulfilment of such obligations (“Force Majeure Event”). However, in the event the Force Majeure Event lasts for at least 14 days, the Customer shall have the unlimited right to cancel his or her order, so long as the goods relating to the order have not been shipped.
Amendments to these terms
Company reserves the right to unilaterally amend its terms of delivery and other terms applicable to online purchases from its store, such as terms concerning privacy, shipping costs and returning products, by posting a new version of its terms and conditions on its website. As the buyer, you have an obligation to read through these terms before submitting an order.
Governing law and dispute resolution
These terms shall be governed by Finnish law except for its provisions on the conflict of laws. In so far as you are a consumer residing outside Finland, the legislation of your domicile shall apply except for its provisions on the conflict of laws in the event and to the extent that Finnish law cannot be applied due to mandatory law.
Any disputes relating to or arising from these terms shall be resolved by the court of competent jurisdiction. In addition, consumers have the right to bring any dispute relating to or arising from these terms to the Finnish Consumer Disputes Board, and to seek consumer advice from the Finnish Competition and Consumer Authority: www.kkv.fi/en/, or other competent national consumer authority.
